Immigration System of "Express Entry" to Canada

In January 2015, Canadian Federal Government has introduced a new Immigration System of "Express Entry" to Canada that will manage permanent residence applications to all Canadian Provinces, except Quebec. The following programs will be managed through the Express Entry system:

  • Canadian Experience Class
  • Federal Skilled Worker Program
  • Federal Skilled Trades Program

Immigration System of "Express Entry" to Canada will have two steps:

  • Immigration candidates will create an online profile in the Express Entry electronic system, and qualified candidates will be added to the electronic pool of candidates
  • Immigration candidates with the highest-ranking in the Express Entry electronic pool will be invited to apply for permanent residence in Canada

The Federal Government of Canada intends to process within 6 months the immigration applications of candidates who will be invited to apply for permanent residence under the System of "Express Entry" to Canada.

Business Immigration to Canada

There are 4 business immigration categories under the Federal business immigration program:

  • Start-Up Visa
  • Investor
  • Entrepreneur
  • Self-employed

Skilled Workers

Candidate must have at least one year of continuous full-time paid work experience or the equivalent in part-time continuous employment in Skill Type 0 (managerial occupations) or Skill Level A (professional occupations) or B (technical occupations and skilled trades) on the Canadian National Occupational Classification list, accumulated within the last 10 years.

Candidate must have at least 67 points under the following six selection factors:

  • Language skills in English and/or French (Canadian Language Benchmark 7, at least)
  • Education
  • Work experience
  • Age
  • Arranged employment in Canada
  • Adaptability in Canada

In addition, candidate must demonstrate that he/she has enough money for supporting himself/herself and his/her dependents while settling in Canada, unless candidate is already working in Canada. Also, candidate must provide proof of fulfilling the minimum language requirements and get Educational Credential Assessment (ECA) from one of the approved organisations before submitting immigration application under the Skilled Worker category.

Skilled Trades

Canadian Experience Class

Persons who have worked in Canada may be able to apply for Permanent Residence in Canada under the Canadian Experience Class.

In order to apply for Permanent Residence in Canada under the Canadian Experience Class the person must:

  • plan to live in Canada, but outside the Province of Quebec
  • have worked in Canada legally for at least one year full-time (or equivalent) as a skilled worker
  • have worked, or studied and worked in Canada with properly obtained work permit, or study permit and work permit
  • submit an application for Permanent Residence in Canada under Canadian Experience Class while working in Canada, or within one year of leaving job in Canada
  • have sufficient knowledge of English or French

According to the Canadian National Occupational Classification (NOC), skilled worker should have:

  • Skill Type 0 (managerial occupations) or
  • Skill Level A (professional occupations) or
  • Skill Level B (technical occupations and skilled trades)

Family Sponsorships

Canadian citizen or Permanent Resident of Canada may be able to sponsor family members to immigrate to Canada as sponsored family members and become Permanent Residents of Canada.

If requirements of the sponsorship process are satisfied, Canadian citizen or Permanent Resident of Canada may sponsor the following categories of family members:

  • Spouse of opposite sex or same sex (and dependent children of the spouse)
  • Common-law partner of opposite sex or same sex (and dependent children of the common-law partner)
  • Conjugal Partner of opposite sex or same sex (and dependent children of the conjugal partner)
  • Dependent Children
  • Adopted Children
  • Parents (and their dependent children)
  • Grandparents
  • Orphaned relatives under 18 years of age and not married or in a common-law relationship, such as: brothers or sisters, nephews or nieces, granddaughters or grandsons
  • Another relative, if a Canadian citizen or Permanent Resident of Canada has no living spouse or common-law partner, conjugal partner, a son or daughter, parent, grandparent, sibling, uncle, aunt, nephew or niece who could be sponsored as a member of the family class, and has no relative who is a Canadian citizen or a permanent resident or registered as an Indian under the Indian Act

Humanitarian & Compassionate Applications

Persons may submit an application for Permanent Residence in Canada on Humanitarian and Compassionate grounds, provided that their personal circumstances are such that the hardship of having to obtain a permanent resident visa from outside of Canada would be unusual and undeserved or disproportionate.
